You all have the benefit here of watching, in real time, an experienced savvy judge close down slowly and methodically every avenue of escape for the US government. This is an outstanding forensic exercise. They are becoming cornered. Keep watching.

This is what is known as "not a good day in court" for the US federal government lawyers. Perhaps they will work out a better, more robust position, to thrive on the confrontation. But now: they do not seem to have a clue about how to address fairly predictable issues. All a bit amateur hour.
