A year ago today, we had a really terrible election night, and because I know how people fall into despair I sat down at 11pm and wondered what I could tell you. I told you:

Ellis is done. The preliminary injunction has been entered. Ellis grants plaintiff's request to certify the lawsuit as a class action, which means it applies to more than just the named plaintiffs and includes all nonviolent protestors as well as those engaged in news gathering & religious practice

Ellis orders that agents wear "conspicuous identification" in two separate places and wear and activate body-worn cameras while engaging in enforcement actions.

Those warnings must be given "at a sound level where the targeted individuals can reasonably hear it," Ellis says

Federal agents can only use force when it is "objectively necessary to stop an immediate threat of the person causing serious bodily injury or death to another person." There must be two separate warnings given before force is used, Ellis rules.

Ellis says she will not order the plaintiffs to post a bond. Ellis anticipates the Trump administration's request to stay her injunction pending appeal. She says she will not do so.

Ellis is concluding, with John Adams words to his wife in 1775 about the need to fight for the nascent American democracy. "Liberty once lost is lost forever."

Ellis says she is "ordering complete relief to the plaintiffs."

Ellis "The public ... has an interest in its citizens' bodily integrity, the right to peaceful protest, the right to assemble, the right of peaceful free exercise of religion."

Ellis: The use of force during the Trump administration's Operation Midway Blitz "shocks the conscience."

Ellis: "It is difficult to see how an injunction ordering the government to comply with the Constitution can be harmful."

Ellis: "I see little reason for the use of force that the federal agents are currently using. Pointing guns, pulling out pepper spray, throwing tear gas, shooting pepper balls and using other less lethal munitions do not appear to be appropriate."

Ellis rules that the Trump administration impermissibly prevented the free exercise of religion, in violation of the First Amendment. Those engaged in prayer have been shot, without warning, with pepper balls and tear gas, Ellis says.

I have lost count of the number of times that Ellis has said the Trump administration's arguments "lack credibility."

The Trump administration treated anti-ICE protestors worse because of the content of their speech, in violation of the First Amendment, Ellis says. In fact, the president and Secretary Noem have said exactly that, Ellis says.

Ellis says the Trump administration impermissibly prevented members of the media (including @peoplesfabric.com & @blockclubchi.bsky.social) from reporting on Operation Midway Blitz.

Ellis rejects the DOJ's argument that plaintiffs are not protected by the First Amendment because they've "intermingled themselves with rioters." "The unlawful activity by a few protesters does not transform a peaceful assembly into an unlawful assembly," Ellis says

Ellis says the First Amendment right to speech and assembly are the "most perishable."

Ellis: Chicagoans have been tear gassed, stared down the barrel of a gun and been "slammed to the ground with their head bashed into the street." "All of that would cause a reasonable person to think twice about exercising their fundamental constitutional rights."

Ellis: "It doesn't matter that someone continues to go protest, or continues to be courageous. That is irrelevant as to whether there was a chilling effect."

The plaintiffs have experienced violence for exercising their First Amendment rights under the constitution, Ellis says. Some have had that protected expression chilled by the violence from federal agents, Ellis says.

Ellis: "those are the factual findings that I'm making to support this preliminary injunction." "This conduct shows no sign of stopping," Ellis says.

No evidence that a man thrown to the ground in Evanston on Oct. 31 by agents who had his head "bashed into the ground" and was punched at least twice in the head "grabbed the genitals" of a federal agent, Ellis says. "Nor would such force have been appropriate even had that been true," Ellis says

Ellis on what happened on Oct. 14 on the East Side: "Agents pushed, shoved, tackled protesters, pointed guns at them, threw tear gas and deployed smoke canisters. Everyone that agents detained were released by the FBI, and none of them are currently charged with assault."

Ellis is now moves to Oct . 24 in Lakeview: No evidence that anyone tried to deflate the tires of a vehicle carrying federal agents. Video captured by body-worn cameras recorded one agent mocking the crowd as tear gas was deployed, saying twice, “have fun!” and laughing as they fled, Ellis says

Bovino did not warn protestors in Little Village before he deployed tear gas, Ellis says. Ellis: "That happened after I entered the TRO."

Ellis: Federal agents described a number of protestors as "professional agitators" based on their use of whistles, in part. "Describing neighborhood moms and rapid response groups as professional agitators shows just how out of touch these agents are and how incredible their statements are."

Ellis says she finds the testimony of youth organizer Leslie Cortez, who told the court an immigration agent pointed a firearm at her head on Oct. 1 when she began recording them as they detained day laborers in a Home Depot parking lot on Cicero Avenue, credible.

Ellis is painstakingly details what happened to Juan Munoz, a trustee on the Oak Park Village Board, who was arrested during a protest at the Broadview immigration processing facility in early October. Munoz was "used as a prop for Department of Homeland Security videos," Ellis says.

Agents said "hit them" before deploying tear gas, Ellis says, and then they lied about it under oath. This calls into question their account of everything happening in the Chicago area.

Federal agents tried to claim a flash-bang grenade they fired in Little Village was fireworks thrown by protestors, Ellis says. Agents also lied about what happened in Albany Park on Oct. 12, Ellis says.

As for the testimony of Border Patrol Chief Patrol Greg Bovino: Ellis: "Defendant Bovino admitted that he lied about whether a rock hit him before he deployed tear gas in Little Village." When Bovino threw a second tear gas canister at the crowd, the crowd was running away.

Ellis says she watched hours and hours of footage at the request of the Trump administration. On Sept. 19, agents fired flash-bang grenades at protestors outside the Broadview ICE facility without warning. Feds are responsible for "instigating the chaos," in Brighton Park on Oct. 3.

"I find the defendants' (the DOJ) evidence simply not credible."

"The government would have people believe, instead, that the Chicagoland area is in a vice-hold of violence." "That is simply untrue," Ellis says.
