"All persons born or naturalized in the United States...are citizens of the United States." That's the 14th amendment. And four MAGA activists in robes said, "nah." They barely lost while demonstrating how illigitimate this court is. Term limits and expansion or bust.

About Trump v. Barbara: Do not give the Court and the CJ credit for reading and upholding the Constitution. It's a travesty that this is not a unanimous decision... it's also a travesty that the Court let this question percolate for a year, giving credence to a crank theory of citizenship.

Kavanaugh only concurred in the judgment on the grounds that legislation but not an executive order can change the scope of birthright citizenship. Today’s other decisions are horrific and on this they were one vote away from rolling back the constitutional status of citizenship back to Dred Scott.

I am stunned that the constitutional question was so close. I thought it would be 6–3 or 7–2. It is profoundly disturbing that four justices would allow either the president or Congress to rewrite the plain text of the 14th Amendment. This is obviously a good outcome, but the margin is alarming.

That this wasn’t 7-2 is just another flashing red alert that this court has to be reformed and expanded.
