Harder to get a read on Judge Bade, who was singularly focused on whether the FPS diversion of forces is enough to justify federalizing under prong 3 (inability to execute the laws).

My initial read on this argument: Judge Nelson is eager to disagree with his 9th Cir. colleagues that federalizing the NG is reviewable at all. He's also eager to disagree with Judge Immergut that the Portland protests were small and under control.

So far this sounds very much like a 2–1 panel decision in favor of Trump having the right to deploy the NG to Portland, Oregon. This is despite TROs usually not being appealable and DOJ appealing Judge Immergut's first TRO but not the second one. (Though the full court might rehear en banc.)
