Frontex’s Director Leijtens is lying. He is not forced to send people back to Libya. In reality, he is obligated by law to stop sharing information with the Libyan Coast Guard. This is exactly what our legal case together with @front-lex.bsky.social aims at. 🧵 1/6

If the FRO does not like the law governing Frontex, he can ask the European Parliament to change it. Until then, the law is clear. Frontex’s chronic failure to comply with it stems from the lack of access to justice before the @eucourtofjustice.bsky.social: Without a court, there is no law.

Contrary to the position of Fundamental Rights Officer @jgrimheden.bsky.social, Frontex does not make the law but must abide by it. The law—Article 46(4)— obliges it to suspend or terminate operations where there are related serious or persistent violations, such as in Greece. 🧵👇

We are another step closer to ensuring effective judicial protection and access to justice for victims of Frontex’s activities, making certain that Frontex’s unlawful actions or inactions do not go unchallenged, and that it may no longer continue to act with impunity. 5/6

FM v. Frontex was filed by @refugeesinlibya.bsky.social and @front-lex.bsky.social on behalf of FM, a 29-year-old Sudanese asylum seeker stranded in Libya, with no access to an asylum procedure or any form of protection from the crimes against humanity committed against migrants there. 2/6

The General Court has decided to reserve its decision on Frontex’s plea of inadmissibility until ruling on the substance of the case. For the first time in such victim-led proceedings, the Agency must submit a Defence to our corroborated allegations, and the Court will examine the substance 1/6
