This administration has a remarkable ability to make what once seemed like subtle critiques abundantly obvious to point of banality.

Interestingly, two very different ways to limit IEEPA: One, the DC District Court's, takes a particular (perhaps particularly problematic) tool - tariffs - off the table, the other, the CIT's, imposes a means-end relationship requirement that might apply across the board, but in a more limited way.

And now the DC District Court goes where the CIT didn't, holding that IEEPA does not grant the President authority over tariffs, finding the prior precedent under TWEA inapposite: storage.courtlistener.com/recap/gov.us...
