My solidarity with trans people isn’t at odds with Reproductive Justice — it’s integral to it. I will keep using inclusive language. I will keep including trans people in my work. Our liberation is bound together. Are you coming along?

The same forces attacking abortion access are attacking gender-affirming care — both rooted in control. We can’t stop at abortion access. We have to dig injustice out at the root, not just when it touches our own gardens.

Abortion is health care — but it’s also about bodily autonomy, self-determination, and the right to shape our own futures. Trans people are in a parallel, interconnected fight.

Pregnant women are people. “Pregnant people” doesn’t erase cis women’s experiences with pregnancy — it expands the frame. It helps make all reproductive health safer and more accessible for everyone.

Many people still think of this work as “women’s rights.” They worry that saying “pregnant people” dilutes the fight for abortion access. If that’s where you’re coming from, I hear you. And I offer this:

Oral arguments are over. I did not hear five justices willing to protect children from psychological abuse. But the fight to protect against conversion therapy will not end with this case. Thanks to everyone who followed the thread on this depressing day at the Supreme Court.

ADF once again attacks the studies as having biased sampling. There isn't a single study affirming LGBTQ people's experiences that the right wouldn't attack, because they KNOW the "perfect randomized study" they demand that tests *obviously* harmful effects could never ethically be conducted.

Colorado's lawyer lays out how ludicrous it would be to try to do some kind of randomized study ON CHILDREN to prove conversion therapy is harmful. We already know enough to know that there's no way such research could be performed ethically, and we know plenty enough without it.

Barrett still sounds skeptical the research shows conversion therapy is harmful, but Colorado's lawyer takes the opportunity to spell out just how robust the research is and correcting the other side's claims that it doesn't speak to "voluntary" speech therapy. (Shoutout to @turban.bsky.social!)

It's really telling the hypocrisy of the conservative justices in today's case vs. Skrmetti. They were eager to enable Tennessee to "protect children" from being trans, but they are very skeptical of Colorado trying to protect children from harm. The only consistency is anti-LGBTQ bigotry.

Justice Thomas has questions about whether there's even a history of regulating therapy and counselors. There, of course, is. It sounds like he really wants mental health to be a total free-for-all. That would be so devastatingly harmful.

A lot of the hypotheticals the conservative justices are tossing around stem from the fact that the plaintiff wasn't ever found in violation with the law. ADF, as it likes to do, filed a pre-enforcement challenge to try to allow anti-LGBQT behavior before the law has even been applied.

Alito wants to know why speech to affirm a minor's same-sex attractions is allowed and speech to reject them isn't "viewpoint discrimination." It's a total strawman. Colorado is insisting the harms come from trying to change orientation, and that's why the law protects against a specific TREATMENT.

Alito is desperately trying to protect the CHILDREN who want to "cope" with their same-sex orientation without changing or reducing it. It's a hypothetical that doesn't make any sense, and it's clear he's trying to justify self-hate in a way to circumvent the ban and thus justify overturning it.

Kavanaugh and Barrett are obsessed with a hypothetical about a dispute in the medical community. There will ALWAYS be a vocal minority that dissents (like hate group ACPeds), but that's not a justification for undermining the mainstream medical consensus on the standard of care.

Justice Kavanaugh wonders if a state could ban AFFIRMING therapy if the standard of care changed. But it's not going to. It's very clear that affirming sexual orientation and gender identity is good for mental health and rejecting them is bad. He's letting his bigotry daydream for him.

Justice Thomas wants to know why religious counselors or life coaches can provide conversion therapy and a licensed therapist can't. The question is an indictment on all professional therapists, and indeed, ADF's defense of this client is an attack on the mental health profession.

Colorado is coming right out the gate noting the importance of the state to regulate medical treatment, and this is a case about a licensed therapist selling a health care service with known harms. Just because the treatment involves words doesn't mean it's not "treatment" — or not harmful.

The federal government and ADF are clearly engaging in a "no true Scotsman" fallacy to criticize the research on conversion therapy. Even though tons of studies have found harm, none — they argue — has studied exactly the specific kind of therapy they're defending, so SURELY it's fine. (IT'S NOT.)

As a reminder: Justice Thomas has been eager to overturn conversion therapy bans for some time. In 2018, when the Court ruled that crisis pregnancy centers are allowed to lie to patients, he openly said so. He's eager for alleged medical providers to lie. archive.thinkprogress.org/supreme-cour...

ADF is trying to have it both ways. They say conversion therapy is "just speech," but also that it's medical treatment that has an impact. It can't be both. If it's medical treatment, it can and should be regulated, and we know from the mental health consequences that the speech is not mere words.

ADF continues to reference CHILDREN's "struggle" with same-sex attractions or trans identity. If the children are struggling, it's only because of constraints on being who they are — aka the shame of their parents. The kids don't "want help"; they are forced into this torture by rejecting parents.

ADF's lawyer just cited the "desistance myth," the very false belief that most trans kids "grow out of it." I wrote about how demonstrably untrue and harmful this myth was nearly a decade ago, and we know even more to that effect now. But the myth persists. archive.thinkprogress.org/transgender-...

The core of conversion therapy is SHAME. It is an attempt to coerce a person to reject their own reality — to convince them that they cannot be happy as who they are. Conversion is not possible, so they are just taught to hate themselves. It's not mental health care; it's psychological torture.

While we have more research about anti-LGB conversion therapy, we do have research on attempts to force trans people to accept their gender assigned at birth. They were more than twice as likely to attempt suicide. The same harm is evident: www.science.org/content/arti...

We have ample research showing not only that conversion therapy DOES NOT WORK, but that it DOES DO HARM. These Supreme Court oral arguments on conversion therapy are going to be painful. No matter what is said, know that trying to force someone to be what they're not is psychological torture with measurable negative consequences, and anyone trying to defend such efforts is a bigoted monster.

9. No formal steps have been taken to enact the Trump’s threat against schools at this time, and NYC schools have assets on their side: backing from local officials, strong equal protections state laws, and a history demonstrating NYC schools’ ability and willingness to tell the feds: “No.”

8. Current NYC policies broadly allow trans students equal access to school facilities (bathrooms, locker rooms), sports, and any other gender-based opportunities or accommodations, as enshrined under city and state anti-discrimination clauses. Laws also back equal access to gender affirming care.

7. New Yorkers aren’t taking threats lying down. “Let’s be clear: the mayor has no authority to ban trans students from using bathrooms that match their gender identity,” NYCLU Executive Director Donna Lieberman told The Gothamist. “Such a move would be illegal under New York State and City laws.
