Umm as I skim Kavanaugh's decision he doesn't accept the 14th amendment, he just wants to pretend this is up to Congress.So it's 5-4 meaningfully.

Even if SCOTUS strikes down Trump's birthright EO today, under no circumstance do you have to hand it to them when the text, legislative history/ intent, doctrine, supporting federal law is crystal clear AND as they lay waste to separation of powers, due process, rights in so many other areas.

It's such a *clear* equal protection violation to me, if for no other reason that trans *men* are not subjected to the same restrictions, only trans women. But, since the court already decided that the constitution doesn't apply to trans women, I can't be surprised.

My favorite part is his assertion of science is supported by a citation to a philosophy article.

As a GGW fan, my first presidency lecture is focused on the First Congress's debate over unilateral removal of cabinet officials and how those debates framed things in the shadow of constitutional silence. One reason, unspoken, is because I like to undermine the silliness of originalism.
