@kevinkenny.bsky.social Just attended a lecture yesterday where the speaker discussed a scholar’s research on a couple of self-emancipated people who went from Missouri through Illinois and Indiana to reach Michigan because of its law on court hearings for accused fugitives.

A bit disappointing to see a discussion of pre-Civil War federalism that doesn't mention how state courts & laws could provide protections for free Black people and fugitives from slavery in some states.

For a historical analogue for today's clashes over immigration enforcement, don't look to secession. Look to resistance – both from the public & from northern state governments – to the Fugitive Slave Law. Proslavery southerners weren't the only ones who could wield states rights as a tool.

Pro-slavery southerners were perfectly happy with federal power when it used to protect their interests, local laws and self-determination be damned - think, the fugitive slave law and a federal slave code for the territories.

A century later: when my mom’s family came from Germany in 1939, first they were diverted to Cuba, and only when Texas-based relatives posted a bond vouching they would not become a burden on the state were they allowes into the U.S.

In New York v. Miln, the first immigration case to reach the Court, the majority upheld a state law requiring passenger reports as a legitimate exercise of police power. The ruling reassured slaveholders that Congress would not interfere with state laws regulating the movement of free Black people
