OTD in 1863, James Gordon Bennett's New York Herald had this to say about Lincoln's Emancipation Proclamation, which was to take effect that day. Bennett espouses a kind of popularism, worrying that Lincoln might have gotten dangerously ahead of public opinion and might enrage the Confederacy.

I find that the baseline for many lawyers using history in their arguments is to pull quotes with zero regard for context and then say “see, I proved my point.” It is lazy, egotistical, and harmful in the extreme.

That’s it. Roberts’ court has crowned what they define as originalism, and used it as a sledgehammer to overturn U.S. laws, precedents, & norms. He here defines the court’s “originalism” as legitimately based solely on the Constitution, not the Declaration. It’s an interpretation. And it’s wrong.
