I'll just say that I am *more* surprised by Justice Gorsuch's vote in the birthright citizenship case than I am by Justice Kavanaugh's. I had thought the 6-3 tariffs lineup was a real possibility after the oral argument, but not 5-4 on the constitutional question.

And I thought even more lopsided was a distinct possibility, that all but Thomas and Alito would use the case, knowing that it was a loss for Trump, to burnish some sort of bipartisan credentials. On the contrary, the bottom line is that this is a boldly uberconservative court.

Kavanaugh isn't talking about a constitutional amendment. He's talking speculatively about a law that might be passed by Congress to ban citizenship for children born here if their parents are here illegally.

Early last year, I wrote about what I called the "rule-of-law" split on the Supreme Court—where Chief Justice Roberts and Justice Barrett joined the three Democratic appointees in 5-4 rulings. Cook was an example of this yesterday; the Fourteenth Amendment holding in Barbara is a bigger one today.

Birthright citizenship survives. But Thomas, Alito & Gorsuch ruled for dictator Trump over the clear words of the 14th Amendment. And Kavanaugh said Congress (rather than Trump) could ban birthright citizenship in the future. 4 justices are out-and-out fascists. Win the midterms. Expand the court.

Among lots of things that are striking about Kavanaugh's opinion in the birthright citizenship case is the totally unnecessary dissent on the constitutional question. He could've just concurred in the judgment on the statutory question *without* discussing the 14A, but went out of his way to do so.
