Since Ross has yet to be charged with murder, reporting that his legal fees are paid by DOJ, which means the taxpayers, is the better argument.

The DOJ (actually, we the taxpayers) pays the legal fees of any officer being investigated or prosecuted for an incident arising out of the course and scope of his employment. Trump/noem clearly believe Ross falls in that category. He has no legal fees. The stated purpose of the fund is a fraud.
