Tomorrow, @bsky.app will begin requiring all users in Ohio to submit facial scans, government IDs or other identity info to access the site, in order to prevent prosecution under the state's age-verification law. Meanwhile, X does nothing. Because it likely doesn't fear prosecution.

The Ohio law is written incredibly poorly and confusingly, and there are reasons to believe that @bsky.app might not actually have to comply. However, all enforcement power is given to the AG in a deeply conservative state, and the law is vague. They can decide who is liable.

So X, which has a whole dedicated NSFW business is less liable to see an AG go after them than a left-leaning platform like @bsky.app which merely allows adult content. As a result, all OH users now risk surveillance to access even political content on the site. This has always been the problem.

We're likely to see more asymmetrical enforcement with age-verification, where those who are politically aligned with the state's DOJ do not feel the need to comply while those who are not either self-censor or self-surveil. Hurdles are placed to access left-leaning voices and communities.

And those hurdles aren't nothing — they open the real risk of government surveillance post-Kirk EO when left-leaning communities are being broadly threatened with investigation for incitement to violence. This was never about jsut preventing access to "porn"

This is one reason why @fsc.bsky.social has been so active in fighting these laws, and what groups like @fightforthefuture.org @eff.org @aclu.org @woodhullfreedom.bsky.social @thefireorg.bsky.social and others have warned about. Sex is the canary in the coal mine of free speech.
