This pre-shooting video clearly shows victim holding a phone as if to film. Agent lays hands on first. Victim does not resist, walks backwards as agent pushes. Fellow observer does not interfere. Zero indication of aggression from victim, who appears only to be filming.

The NYT reporting that video analysis shows he was holding a phone when he approached ICE. He may have been carrying a gun, which he was legally permitted to do.
