⚖️ NEW: the DOJ filed a motion for a 30 day extension in which to file a petition for any rehearing or rehearing en banc in US v. Giraud (the Alina #Habba disqualification case). The petition would have been due Mon. Dec 15; at the DOJ’s request and appellees’ consent it will now be due Wed. Jan 14.

The reporting is that republicans won’t extend ACA subsidies without Hyde language added to the ACA (which is essentially what Josh Hawley’s legislation S. 3011 calls for). Federal law preempts state law. If you get health insurance through the exchange, you wouldn’t have access to abortion care.

If democrats do not get anything in writing NOW about an ACA that DOES NOT include any Hyde language, then I’m very worried about how that plays out in future negotiations. As I was saying last night, I’ve been worried ever since Josh Hawley introduced S.3011. I implore you to call your senators.
