I just read the signed 13 page merger document between Ruby Central and Ruby Together. No where does it specify that ownership of the RubyGems source code is being transferred to Ruby Central. Ruby Together never owned it in the first place. Ruby Central are lying.

Agreed, and I think this unfortunately echoes the mess we've seen with Wordpress governance over the past year. It turns out it's hard to divest from a leader who owns relevant legal rights and controls the spigot of money to an ecosystem. Enormous sympathy to everyone invested in Rails today.

Part of designing open source governance is making yourself resilient to capture. It seems Ruby Central has been captured by DHH, who is now (if reports are true) primary financial backer.
