I agree. And would add that successfully invoking 25th Amendment against an unwilling president is actually MORE difficult than impeachment and removal. Not less.

Regardless of whether he’s a “real” Native American, this is not a defense against a discrimination suit. People can and do discriminate against their own group and/or in favor of others. Many cases show this.

The most promising potential for a genuine policy issue realignment has been for Dems—across the board including progressives—to unapologetically embrace international free trade. Negatively polarized into it, sure. But the right result and a natural fit going forward even after Trump is gone.

It’s debatable whether the First Amendment protects a high-level administrative employee from being fired in a case like this. But it’s ridiculous that qualified immunity would apply. This isn’t cops making a difficult decision on the fly. It’s university officials with plenty of time/legal advice.
