President Trump continues to get the history of the 14th Amendment wrong. He says birthright citizenship was only granted to newly freed slaves. But the 14th Amendment was clearly broader than that – and everyone at the time knew it.

In Trump v. Casa, @stevespaulding.bsky.social tells @cbsnews.com.web.brid.gy the Supreme Court went "out of its way to make it more difficult for courts to reign in" executive overreach. While "it narrowed the tools available to block illegal conduct ... there are other tools available."

Remember that the EO purporting to limit birthright citizenship is just as unconstitutional today as it was yesterday. The constitution makes clear that babies born in the U.S. are American citizens. Period.

As Justice Sotomayor explains in dissent, the decision “renders constitutional guarantees meaningful in name only for any individuals who are not parties to a lawsuit.” /5

That being said, this is a terrible ruling that curtails courts’ power to enforce the law in a quite radical way. The ruling prohibits so-called universal injunctions, orders that apply to non-parties in a case. /3
