The CJEU has declined to fast track a second batch of questions referred from Italian courts related to the Italy/Albania asylum deal. So in the short term the issue is up to politics - if the EU wants to pass an emergency asylum law or ordinary legislation to bring forward parts of the asylum pact.

Here we are! My impressions are out about the hearing in Comm v Hungary (Anti-LGBTQ+ Law) on the justiciability of EU values in Article 2 TEU. 16 States, Comm and Parl joined an emergency call to the CJEU to uphold EU values against democratic backlash. In Geneva today 🇨🇭 to present an ongoing research with my colleague Francesca Bandini, on another CJEU hot potato: role of effective judicial protection in CFSP in the light of the recent KS and KD cases, whether the result is a coherent and complete system of remedies (spoiler: our answer is no)

The hearing is over. The afternoon was taken with differentiation/overlapping of art. 2 (Values) and art. 7 (political proc x values breaches), clarifications on the "standalone-non-standalone" role of EU values (esp. in infringements) and the role of values vis-à-vis the scope of EU competences. 1/

Indeed: according to COM, pushed by CJEU, there is no genuinely “freestanding”/genuinely autonomous Art 2 TEU invocation in infringements. Article 2 TEU can only form the (separate but connected) apex of an infringement action based also on other primary and secondary Union law

Q to Malta about different possible meanings of Art 2 concepts, liberty and democracy. Does their coexistence reduce their potential meaning? Malta: coexistence does not exclude interpretation, but link to (other) EU norms helps delimit meaning of Article 2 concepts (Vintage Sarmiento brilliance)

to place this hearing in context, it is extremely unusual for so many Member States to line up against one of "their own"
