the sheer number of bad takes & lack of knowledge i’m seeing across multiple platforms on the 23XI-NASCAR case is single-handedly motivating me to finish my episode outlines

i have a final in 3 hours but trust & believe i still listened to the NASCAR 23XI appellate oral arguments this morning but since i don’t have time to record & edit a real episode i offer you my somewhat stream of consciousness thoughts via thread (not legal advice as per usual)

on this note i really want to get two episodes about this case out before oral arguments on May 9 so stay tuned to see if that happens

expected this but it’s a big deal to see it in a court order it basically means the teams can focus on the second element of their claims going forward because a court has established the first one

love this footnote where they essentially say that the release is so vague that they probably couldn’t determine with certainty whether it encompassed antitrust or not or had any effect at all but because NASCAR said it encompassed antitrust, the court says it does too 💀

after 4:30 on friday i will be fully immersing myself in this case for a month so get ready

it is incredibly annoying that F1 probably did something illegal & basically got exactly what they wanted out of it (no andretti but yes GM) & will face exactly zero punishment because they accepted the bid in the end like is anyone also feeling insane about this

i am realizing you can tell how insane i feel about something by how many different voices i use to read quotes or say things (it gets noticeably worse as the cadillac episode goes on)

If i’m guessing, it became a criminal investigation when they realized they needed the WhatsApp messages. Subpoenaing WhatsApp won’t get you much info. Because of end to end encryption, they probably needed a warrant/consent to search someone’s phone to get 100% of the message content.
