The 8th Circuit also upheld 922(g)(9) this month, which prohibits those convicted of a misdemeanor DV crime from possessing firearms. US v Bernard, 2025 WL 1352397. The 8th relied on the high rates of recidivism in DV to find that individuals convicted of DV pose a clear threat to others.
