The state of Nevada can't dictate federal immigration policy, but state lawmakers are being urged to take what steps they can to protect Nevadans from egregious and illegal federal enforcement tactics and actions.

State lawmakers had hoped to ask about deportation and detention operations in Nevada, including recent judicial orders saying the federal agency was in “open defiance” of a federal district court ruling by denying bond hearings.

In its decision, the court held that children born in the United States to parents unlawfully or temporarily present are “subject to the jurisdiction” of the United States and are citizens at birth under the Fourteenth Amendment’s Citizenship Clause.

This morning's ruling hurts, but the statutes at issue in West Virginia and Idaho differ from Nevada’s state laws and constitutional provisions, and we are analyzing the case in light of this.

In three rulings this week related to immigration policy, the United States Supreme Court weakened due process and equal protection standards. We will continue to fight for every community targeted by those who wish to destroy America’s promise of equal protection.

In the unanimous opinion, the Supreme Court upheld that the government cannot impose arbitrary and discriminatory penalties simply on the basis of marijuana use. With nearly half of Americans reporting marijuana use at some point in their lives, this ruling protects the rights of millions.

“The onus is always on defendants or people in the community to be accountable... The system is victimizing people and it’s not just Rickie … Where is the accountability for that?"

The DMV disclosed that it had unlawfully withheld 110 documents in a court filing March 3. It has only handed over seven of those records, the ACLU says.

The ACLU's Athar Haseebullah said it's not clear to him “how the DMV can simply walk back its erroneous representations about not using Signal to communicate as recently as two weeks ago,” adding “it’s even more bizarre that they’d expect the public to just take their word for things.”

"Just because we don’t have people in armed fatigues walking through East Las Vegas does not mean that ICE has not ramped up considerably,” said Michael Kagan, director of the UNLV Immigration Clinic.

“I have to say, based upon what I’ve reviewed so far, I’m leaning towards a penalty, but I want to see all the records produced,” the judge said.
