In the latest update to the Equal Treatment Bench Book, chapter 12, ¶48 is a breath of fresh air: '"Assigned at birth" is used by trans people (and others) instead of biological sex, but is not widely understood, and it is therefore to be avoided by judges.'

The answer was no. No-one wanted to try to explain to me why men getting infants to suck on their nipples might (even sometimes) be ok. On balance I suppose I find that faintly reassuring, in a rather bleak way.

Utterly absurd, and wrong, that this post is marked by @bsky.app as "intolerance". In reality it consists of links to serious legal analysis, from someone whose opinion you might agree or disagree with.

This gives me far too much credit. It was Maya Forstater who first persuaded me that there had to be a respectable argument that the GRA didn't stick its spanner into the works of the EqA; and @michaelpforan.bsky.social who did the detailed doctrinal work of putting that argument together.

This is fascinating to see. I used to be of the "just read the words of s.9(1)" persuasion, too. I thought the consequences were repulsive, but I couldn't see a way around them.

One of the things that's interesting about this is that it is much more draconian than most social media policies should be. That's because "necessary... for maintaining the authority and impartiality of the judiciary" is one of the express justifications for interference with article 10.

There's some truth in this: I'm not a victim. A lot of trolls have been shouting at me, but that's their stuff not mine.

There's still the odd one of these, but the good news is that the rate has dropped off sharply. Bullies feed on fear, so if you're not scared of them you're no fun at all.
