Ethical considerations in decision making - important to move beyond the binary! Sharing decisions and seeking counsel is seen as wise in people with capacity but as weakness in people who lack capacity

Reframe the capacity question - optimize mental status first (delirium, meds)! Can we increase community support? Specifically identify domains of capacity - global, medical decisions, placement/discharge planning, or financial

Capacity (from a psychological perspective) - need to have some functional abilities (express a choice, rationale, comprehension, choice in line with expressed values). Usually financial capacity is the first domain with concern but not always recognized.
