Compassionate release is a legal mechanism that allows certain incarcerated individuals to be released before serving their full sentence under specific circumstances. The specific criteria, procedures, and eligibility requirements for compassionate release vary by state and jurisdiction.

March is National Criminal Justice Month! For innocence organizations, National Criminal Justice Month is especially significant because it provides an opportunity to highlight wrongful convictions, educate the public about systemic failures, and advocate for reforms that strengthen fairness.

63 years ago today, the Supreme Court issued its landmark decision in Gideon v. Wainwright, ensuring the right to counsel for all. The decision in Gideon v. Wainwright established that the Sixth Amendment guarantees the right to legal counsel for defendants who cannot afford an attorney.

Today is the World Day of Social Justice. At Innocence Project Delaware, we recognize the vital role that strengthening justice systems play in preventing and addressing wrongful convictions, and we celebrate the efforts of advocates around the world who are working to advance social justice.

The practical, scientific, and policy limitations of DNA evidence reveal that while it is a powerful tool, its effectiveness is constrained by limited availability, high testing costs, degradation, and restrictive laws, preventing wrongfully convicted individuals from accessing exculpatory evidence.

Since the first DNA exoneration in 1989, there have been 614 DNA exonerations in criminal cases. In the context of the death penalty, DNA evidence has played a role in only 38 exonerations across 15 states, representing just 18% of the roughly 202 death row exonerations in the modern era.

DNA evidence can reveal valuable information, but is not consistently present in criminal cases. As a result, wrongful conviction cases may offer no DNA evidence that can later be tested. Even when biological evidence exists, DNA testing depends on whether it was properly collected and preserved.

An Alford plea is a plea deal in which a defendant maintains their innocence while still accepting a criminal conviction. It often occurs when a defendant knows they did not commit the crime but recognizes that the prosecution has strong evidence and that going to trial carries significant risk.

There are currently three pieces of proposed legislation in Delaware that would impact the post-conviction process: SB 57, 58 and 214. Senate Bill 214 goes to the Public Safety & Corrections Committee tomorrow, January 28th at 10 AM.

Across the country, group exonerations are exposing the deep flaws in our criminal legal system in cases where entire groups of people were wrongfully convicted for crimes they didn’t commit.

Just how prevalent are wrongful convictions? Studies estimate that between 4-6% of people incarcerated in U.S. prisons are actually innocent. Based on the total U.S. prison population of roughly 2 million, it is estimated that 80,000 to 120,000 innocent people are currently incarcerated.

A few weeks ago, we were thrilled to join the 2025 LYTE Career Expo at Salesianum! It was an inspiring day connecting with high school students and sharing how Innocence Project Delaware works to advance justice in our legal system. We loved meeting so many bright minds eager to make an impact.

September is Suicide Prevention Month, a time to raise awareness, reduce stigma, and encourage open conversations about mental health. This recognition is especially important in prisons and jails, where rates of suicide are significantly higher than in the general population.

Delaware’s 2025 legislative cycle ended in June. We wanted to highlight some legislation passed in the 153rd General Assembly that will reform our criminal legal system: House Bill 53, Senate Bill 10, Senate Bill 7, House Bill 43, and House Bill 142.
