Yesterday, the AB government tabled Bill 9, invoking the notwithstanding clause to shield three policies affecting trans youth. With a rise in the unprecedent use of the clause in the last month, we talked to Marion Sandilands about what's going on:

What's Happening with the Notwithstanding Clause?: Interview with Marion Sandilands
In this latest CCS interview, Marion Sandilands (Conway Litigation) talks to Richard Mailey (CCS) about what's going on with the "new age" of the notwithstanding clause after its unprecedented invocation by two provinces in the same week: in Quebec's passage of Bill 94 and Alberta's passage of Bill 2. Find details on Quebec's passage of Bill 94 from the Quebec National Assembly: https://www.assnat.qc.ca/en/travaux-parlementaires/projets-loi/projet-loi-94-43-1.html Find details on Alberta's passage of Bill 2 from the Alberta Legislative Assembly: https://www.assembly.ab.ca/assembly-business/bills/bill?billinfoid=12087&from=bills

It’s been a busy week for the notwithstanding clause. Days after the clause was deployed in AB, yesterday saw the clause invoked in QC through the passage of Bill 94. This bill expands on the 2019 invocation in Bill 21, extending the province’s secularism law to schools.
