Branding all undocumented immigrants as “acting in defiance of law” is an ugly & inaccurate portrayal to advance a thin argument.

Moreover it is a bizarre statement to suggest that undocumented immigrants “cannot give allegiance…or promise to be bound by [our] laws. Somehow undocumented immigrants managed to pay nearly $60 billion in federal taxes in 2022 according to the Institute on Taxation & Economic Policy.

Undocumented immigrants manage to obey the speed limit of the states in which they reside and adhere to local laws. Indeed they are more likely to exercise care in abiding by law for fear of deportation.Studies consistently demonstrate that immigrants are LESS likely to commit crimes than citizens.

Nearly 40% of undocumented immigrants are those who have overstayed their visas. It’s a sleight of hand or at best simplistic to frame all undocumented immigrants as incapable of obeying our laws. There are laws and laws.

In any case, Barnett and Wurman serve up the kind of argument the conservative majority on this SCOTUS might want to play with (“you had me at Blackstone”). But that doesn’t make it a sound one. Fin.
